WEXO PREMIUM Terms and Conditions

Please read the following terms and conditions ("Premium Terms") carefully before you enter into any transaction with WEXO Limited ("WEXO"), the WEXO website ("Site"), which is owned and/or operated by the WEXO Limited ("WEXO") and/or the premium services provided through the Site including but not limited to the ASK WEXO and WEXO REDIRECT Service (collectively, the "Premium Service"). You acknowledge that by accessing the Premium Service you are agreeing to abide and be bound by these Premium Terms and that these Premium Terms form the basis of the contract between you and WEXO relating to your use of the Service. You should review these Terms periodically for changes. NOTE: WEXO does not provide any warranties relating to the Service. These Premium Terms contain provisions which limit WEXO's liability and you should consider these carefully before you use the Service (in particular, see paragraphs 13 and 15.1 (Liability) and 14 (Indemnity) of the standard Terms and Conditions). 1. Placement Fees

1.1 WEXO is FREE for companies to register, create profiles and post opportunities.

1.2 Work experience aside, WEXO requires companies to pay a minimum placement fee even when not selecting the premium options if they engage someone who is referred by WEXO:

 

2. Company Deposits

2.1 WEXO requires companies to pay a deposit of £100 (less with discount VOUCHER CODE) to view full candidate profiles (including CVs) and make contact with them.

2.2 If WEXO does not help a company fill a position, or if the position is genuine work experience for under 18s, WEXO will refund the deposit in full or credit the account for further listings.

2.3 WEXO will be the final arbiter of whether or not a position constitutes 'genuine work experience'. In practice, WEXO views 'work experience' as shorter term (1-2 weeks) placements for younger people (16-18 year olds) which are generally unpaid although we encourage companies to pay travel and lunch costs.

 

3. Premium Options

WEXO has two premium options that allow companies to source their ideal candidates or choose how they receive their applications:

4.1 ASK WEXO offers companies the following options:

4.2 The following fee is payable in respect of each Engagement:

5. WEXO Redirect

5.1 WEXO REDIRECT includes both Spotlight (or corresponding advertising) and a Targeted Email (see 4.1 and 4.2) as well as the options to redirect interest and traffic clicks to a dedicated webpage (micro-site or in-house Application Tracking System) OR to receive applications direct to a specified email address (with WEXO profile or CV attached). WEXO Redirect is priced per time period:

6. WEXO Payroll

6.1 4-12 WEEK ENGAGEMENTS: Irrespective of where they are found, WEXO can pay recent graduates or undergraduates the National Minimum Wage (NMW) of £210 a week as a ‘training allowance’.The charge to companies is £300 a week.4 This is the equivalent of a gross annual salary of £13,037.

6.2 TOP-UPS / EXTENSIONS: For any placements in excess of 12 weeks or gross annual salary equivalents in excess of £13,037, WEXO can operate payroll at a fee which is calculated as a percentage of gross equivalent annual salary – from 9% to 12% using the standard thresholds.

7. Payment

7.1 All Fees may be paid online or via invoice.

7.2 The Fee is payable within 7 days from the date of presentation of the Business' invoice to the Client.

7.4 The Business reserves the right to charge interest on invoices not settled within 7 days of the date of the Business' invoice and on invoices subsequently issued until paid in full.

7.5 Save as expressly set out in these terms and conditions, the Fee is non-refundable.

8. Miscellaneous (Ask WEXO Only)

8.1 Where relevant, the Client agrees to notify WEXO immediately an Applicant is engaged.

8.2 The Client agrees to supply copies of all correspondence to any Applicant introduced to the Client by WEXO.

8.3 Where such arrangements are concluded otherwise than in the presence of a representative of WEXO, the Client agrees to notify the Business immediately where an Engagement has been accepted by an Applicant and to supply details to the business of the proposed Commencement Date and the proposed duration of the Engagement and the agreed wages.

8.4 WEXO acts as an agent. It does not directly or indirectly employ the Applicant.

8.5 All correspondence and records shall be confidential and remain the property of WEXO.

8.6 Information supplied by WEXO is confidential and is accepted by the Client on the condition that such information will not be disclosed to third parties directly or indirectly.

8.7 WEXO will use reasonable skill and care in providing the Client with Applicants as well suited as possible, and to this end will seek to furnish the Client with all relevant information concerning the Applicant and to check details, documentation and references. However, the final responsibility for any decision to engage the Applicant rests with the Client who is therefore strongly advised to check details, documentation and references personally.

8.8 WEXO does not offer any representation or warranty as to the suitability, honesty, character or capability of any Applicant.

8.9 WEXO accepts no liability whatsoever for any loss or damage of any kind arising directly or indirectly from any act or omission of any Applicant introduced by WEXO even if such act or omission is negligent, fraudulent or reveals dishonesty. For the avoidance of doubt, in no circumstances shall WEXO’s total liability to the Client, whether in respect of goods or services and whether based in negligence, breach of contract, misrepresentation or otherwise, exceed the fee paid by the Client.

8.10 Unless otherwhise specified, The Client is responsible for employing the Applicant and for paying the Applicant's wages and expenses.

8.11 The Client is responsible for all tax and national insurance matters, where applicable.

8.12 For the avoidance of doubt, the Client is liable to pay in addition to the Fee, any value added tax or other duty due and all taxes, duties and other liabilities, howsoever the same arises in relation to the Engagement of the Applicant.

8.13 These terms and conditions represent a legally binding contract between WEXO and the Client.

8.14 The Client must ensure that the place of work complies with health and safety regulations.

8.15 WEXO cannot guarantee that the Applicant will complete his or her proposed length of stay or engagement and likewise does not guarantee to the Applicant that the Client will retain and pay the Applicant for the associated period.

8.16 WEXO’s selection of applicants will be based on information supplied by the Client to WEXO. WEXO shall not be responsible for any loss or damage or liability suffered by the Client as a result of any inaccuracy in any such information and the Client shall indemnify WEXO against all expenses or liability suffered by WEXO as a result of the inaccuracy of any such information.

8.17 WEXO assesses all potential applicants on the basis of information provided either by the Applicants themselves. WEXO is not responsible for checking the accuracy and reliability of this information and gives no warranty as to the suitability or their ability or willingness to fulfil their responsibilities in terms of any agreement which the Applicant may reach with the Client to which WEXO is not a party.

8.18 No variation of these terms and conditions is to be made without the express written approval of WEXO. If any single element of these terms and conditions should be held to be unreasonable, invalid or unenforceable in any respect such element, illegality or unenforceability shall not prejudice the effect of the rest of these conditions to the extent that they are reasonable, legal and enforceable.

8.19 These terms and conditions supersede any other previous terms of business or any other agreed terms.

8.20 The laws of England shall apply to this contract and the English Courts shall have exclusive jurisdiction.
